Terms of Service

By accessing or using BitWise at learnbitwise.com ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

BitWise is operated by an individual ("we," "us," or "our"). These Terms constitute a legally binding agreement between you and BitWise.

BitWise is an interactive coding education platform that provides programming lessons, coding challenges, projects, and assessments. The Platform includes a free tier with basic features and a paid "Pro" tier with additional features including AI-powered code review.

To use BitWise, you must create an account by providing a valid email address, username, and password, or by signing in through Google. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to update your information as needed. You must notify us immediately of any unauthorized use of your account.

You agree not to:

Use the Platform for any unlawful purpose or in violation of any applicable laws; attempt to gain unauthorized access to any part of the Platform, other accounts, or systems connected to the Platform; submit malicious code, viruses, or any code designed to disrupt, damage, or interfere with the Platform or any connected systems; use the code execution features to mine cryptocurrency, perform denial-of-service attacks, or access external systems without authorization; share your account credentials with others or allow others to use your account; scrape, crawl, or use automated tools to extract content from the Platform; reproduce, distribute, or resell any course content, lessons, or materials from the Platform; circumvent or attempt to circumvent any access restrictions, including subscription paywalls; impersonate any person or entity, or misrepresent your affiliation with any person or entity; or use the AI grading features to generate code for purposes unrelated to the assigned projects.

Free Tier

BitWise offers a free tier that includes access to selected courses, lessons, and basic code execution grading. No payment is required for the free tier.

Pro Subscription

The Pro subscription provides access to additional courses, projects with AI-powered code review, and other premium features. Pro is billed as a recurring monthly subscription through Stripe.

Billing

By subscribing to Pro, you authorize us to charge your payment method on a recurring basis. All payments are processed securely by Stripe. Prices are listed on the Platform and may be updated with prior notice.

Cancellation

You may cancel your Pro subscription at any time. Upon cancellation, you will retain access to Pro features until the end of your current billing period. No refunds will be issued for partial billing periods.

Refunds

We generally do not provide refunds. However, if you experience a technical issue that prevents you from using the Platform, please contact us and we will work with you to resolve the issue or provide a refund at our discretion.

Our Content

All course materials, lessons, assessments, user interface designs, and platform code are owned by BitWise and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.

Your Content

You retain ownership of the code you write and submit on the Platform. By submitting code for grading, you grant us a limited license to process your code through our grading systems (including third-party AI services) solely for the purpose of providing feedback. We do not claim ownership of your code submissions.

Pro subscribers have access to AI-powered code grading provided through Anthropic's Claude API. You acknowledge that:

AI feedback is provided for educational purposes only and may not always be accurate; your submitted code is sent to Anthropic for processing, subject to their privacy policy and terms; AI grading attempts are limited per project as described on the Platform; and we are not responsible for any errors, inaccuracies, or omissions in the AI-generated feedback.

The Platform provides a code execution environment for running your code. This environment is sandboxed and subject to resource limitations. You agree not to abuse the code execution service by running code that consumes excessive resources, attempts to access external systems, or violates the acceptable use policy above.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or secure. We do not warrant that any learning outcomes or results will be achieved through use of the Platform.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BITWISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct that we determine to be harmful to the Platform or other users. You may delete your account at any time by contacting us.

Upon termination, your right to use the Platform will immediately cease. Any provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
